Philippine Supreme Court defers ruling on EDCA's constitutionality

The Philippine Supreme Court failed Wednesday to come up with a ruling on the constitutionality of the Enhanced Defense Cooperation Agreement (EDCA) between the Philippines and the United States.

Supreme Court spokesman Theodore Te said he could not disclose whether or not EDCA was part of the court en banc meeting when asked if the justices suspended anew the ruling on the issue.

"All I can say is that no decision on EDCA was announced earlier," he said.

The High Court was supposed to rule last month before the Philippines hosted the Asia-Pacific Economic Cooperation Summit, which was attended by U.S. President Barack Obama, on the petition. But this was suspended.

Petitioners of EDCA alleged that this deal, which was signed by the two countries in April last year shortly before Obama's first visit in Manila, was against the Constitution and this needs Senate ratification, being a treaty and not just an executive agreement. Endit
