A man attacked and wounded 23 elementary school students with a knife had his death sentence commuted to a suspended death, the Henan Provincial People's High Court announced after a retrial on Monday.
Min Yongjun, who was initially sentenced to death for intentional homicide in December 2013 by the Intermediate People's Court in Xinyang City, was given death sentence with a two-year reprieve after the Supreme People's Court disapproved the original sentence and asked for a retrial this year.
According to the Henan Provincial People's High Court, Min was diagnosed to be of "limited capacity" through forensic psychiatric evaluation. Penalties for suspects who suffer mental disease might be lightened under China's criminal law.
On Dec. 14, 2012, Min stabbed an elderly woman in Chenpeng Village, then broke into the village elementary school, where he attacked 23 students. Endi
